BuyKingston Terms and Conditions of Supply
This page sets out the terms and conditions that apply when you order from us. By placing an order at checkout, you agree to these terms and conditions.
“BuyKingston”, “us”, “we” or “our” refers to Al-Haatif Ltd, registered office Unit 5, Halifax Industrial Centre, Marshway, Halifax, HX1 5RW, United Kingdom.
“You” or “customer” refers to the user, customer or viewer of our website.
BuyKingston is operated by Al-Haatif Ltd. Company registration number 07294999. UK VAT number GB160932026.
2.1 After you place an order, you will receive a confirmation email acknowledging receipt of your order.
2.2 Once your order has been placed and paid for, it enters our processing system. If you wish to cancel before dispatch, contact us immediately in writing via our contact
page — see Section 3 for your statutory cancellation rights, which continue to apply after dispatch and delivery.
2.3 We are not obliged to fulfil an order where circumstances beyond our control affect its status (see Section 20, Omissions and errors).
2.4 Once we receive your order into our system, we will begin processing and packing it.
2.5 You will receive a dispatch email once your order has entered the dispatch/shipping process. This may be sent at any point during our working day.
2.6 Where applicable, you will receive a tracking email at a later date — normally, but not guaranteed, the same working day or the next working day after dispatch.
3.1 If you are a consumer, you have the right to cancel your order for any reason within 14 calendar days, beginning the day after you (or someone you nominate) receives the goods. This is your
statutory right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
3.2 To cancel, you must tell us in writing via our contact page. A clear statement is sufficient — you do not need to use a specific form.
3.3 Once you have told us you wish to cancel, you must return the goods to us within 14 days of that notification. See Section 11 for the returns process.
3.4 Cancellation under this section does not depend on our acceptance — it is your statutory right, exercised by giving notice. We will acknowledge your cancellation and provide return instructions
(Section 11).
3.5 This 14-day cancellation right is separate from, and in addition to, any return you make because goods are faulty or not as described (see Section 14).
4.1 By placing an order on our website, you confirm that:
4.1.1 you are 18 years of age or older; and
4.1.2 the information you provide is accurate, truthful and correct.
5.1 Our website is primarily intended for UK residents. We reserve the right not to accept orders from residents outside the UK.
5.2 We reserve the right to cancel orders, without giving a reason, before or after payment, for customers residing in or outside the UK.
6.1 Listing a product for sale does not guarantee we can supply it, due to circumstances that may be beyond our control.
6.2 All prices include UK VAT at the current rate of 20%.
6.3 ‘In stock for next day delivery’ applies when we can supply next working day, and is available to UK customers only.
6.3.1 To qualify, you must select a delivery method that guarantees next day delivery.
6.3.2 This does not include weekends or UK national holidays.
6.4 ‘Delivery 2–5 days’ means delivery will take approximately, but not guaranteed, 2–5 working days, regardless of delivery method selected.
6.5 ‘Out of stock’ means the product is currently unavailable.
6.6 International customers (outside the UK) should refer to our international estimated delivery times, found here.
6.7 Delivery messages ‘2–5 days’ and ‘in stock for next day delivery’ apply to UK customers only.
7.1–7.2 We use a variety of delivery companies and delivery methods, details of which are shown at checkout based on your delivery destination.
7.3 By selecting a delivery method at checkout, you agree to the terms and conditions of the delivery company handling your order.
7.4 Delivery times are estimates provided to us by our delivery partners and should be treated as guides only, unless we have explicitly guaranteed a delivery date.
7.5 No delivery dates are guaranteed except:
7.5.1 Royal Mail Special Delivery Guaranteed™.
7.6 If the guaranteed timeframe in 7.5.1 is not met, you are entitled to a full refund of that delivery charge, subject to Royal Mail’s acceptance of the claim.
7.7 We reserve the right to upgrade your order to a courier service — for example, where you select Royal Mail Special Delivery Guaranteed™ and the order value exceeds that service’s insurance
limit.
7.8 Please report any delivery discrepancies to us within 24 hours of receipt.
8.1 We will handle non-delivery claims in accordance with the terms of the delivery method and company you selected at checkout.
8.2 Where tracking shows an order as delivered and you dispute this, you may be asked to sign a declaration of non-receipt provided by the delivery company. Once that company confirms the claim to us, we will
issue a refund.
9.1 All prices include UK VAT at the applicable rate, currently 20%.
10.1 We use secure payment systems, currently Stripe and PayPal, selectable at checkout.
10.2 We accept a range of payment methods — see our payments page.
10.3 We never see your full payment card number.
10.4 We do not accept payment by cheque. Any cheque received will be securely destroyed.
We offer a single, clear return window: 14 days from the date you receive your order (or, for non-tracked deliveries where receipt cannot be confirmed, 14 days from the expected date of delivery), whether you are cancelling under your statutory right (Section 3) or returning for another permitted reason.
11.1 To return an item, you must notify us in writing via our returns page before sending anything back. No other contact method will be accepted.
11.2 Once you notify us, we will send you a Returns Authorisation (RMA) by email within 2 working days. This email will confirm:
11.2.1 your RMA reference number;
11.2.2 the return address;
11.2.3 the deadline by which the item must be returned to us;
11.2.4 whether a freepost label is provided for your order, or, if not, that you are responsible for return postage and are advised to use a tracked and insured service appropriate to the item’s value;
and
11.2.5 any other information relevant to your specific return.
11.3 Please do not return an item without an RMA. Unauthorised returns may be delayed, rejected, or subject to a £25 (ex VAT) administration fee.
11.4 Who pays for return postage:
11.4.1 If you are returning an item because it is faulty, damaged, or not as described, we will cover reasonable return postage costs, or provide a freepost label where available.
11.4.2 If you are returning an item for any other reason (including under your statutory cancellation right in Section 3, where you simply change your mind), you are responsible for the cost of returning it to
us, unless we have expressly offered a freepost label for your order in the RMA confirmation.
11.4.3 Where you arrange your own return postage, please ensure the item is adequately insured and, for items of significant value, sent using a tracked service. We are not responsible for items lost or damaged
in transit using a service you have arranged.
11.5 Freepost returns are available to UK customers only, and only where expressly confirmed in your RMA email. We may withdraw or decline to offer freepost on specific orders, without obligation to provide
freepost on future orders, including (but not limited to) where a dispute regarding the order is open with a third party (such as a card provider or payment processor).
11.6 Once we receive your returned item, it will be logged onto our returns system within 5 working days.
11.7 If you have requested an exchange, this will normally be processed within 5 working days of the return being logged.
11.8 If any additional payment is required from you (for example, for an exchange to a higher-value item), we will contact you and proceed only once you have accepted and confirmed the additional charge.
11.9 Any upgraded or additional postage costs you paid at the time of order are non-refundable if you return the item for a reason other than fault, damage, or mis-description. This applies to UK and non-UK
customers.
11.10 Weekends and UK national holidays are not counted as working days for the purposes of this section.
12.1 To qualify for a refund under our 14-day return policy, returned items must meet the following condition:
12.1.1 the item must be returned in resaleable condition, with no damage beyond reasonable inspection (i.e. as you would handle it in a shop); and
12.1.2 the item must be returned with all original retail packaging, accessories and documentation where applicable.
12.2 If you have opened the item to inspect it (as you would be entitled to do in a shop), this does not by itself disqualify you from a refund — but excessive use, damage, or missing components may result
in a deduction to reflect the diminished value of the goods, in line with your statutory rights.
12.3 If original seals have been broken and the product used beyond reasonable inspection, we may make a deduction from your refund to reflect the loss in value, rather than reject the return outright, where the
item can still be resold at reduced value. Where the item cannot reasonably be resold at all, we may decline the refund and offer to return the item to you at your cost instead.
13.1 Refunds are processed within 14 working days of us receiving your returned item (or, for statutory cancellations, of receiving evidence that you have sent the item back — whichever is
earlier), in accordance with the Consumer Contracts Regulations 2013.
13.2 Weekends and UK national holidays are not counted as working days.
13.3 Refunds are issued to the original payment method used for the order.
14.1 As set out in Section 11, you must notify us in writing before returning an item as faulty.
14.2 Items returned outside the standard 14-day window that develop a fault within the manufacturer’s warranty period will be exchanged on receipt for the same product, if available.
14.2.1 If the original product is no longer available, we will exchange it for a product of the same specification or better, at no extra cost to you.
14.2.2 Current market price is not a factor in this exchange.
14.2.3 If you decline an exchange and instead request a refund, we reserve the right to reduce the refund by 5% per calendar month (inclusive of VAT) since purchase, to reflect use and wear, up to a maximum
reduction of 95%, in accordance with UK law.
14.2.4 For the purposes of this calculation, the calendar month of purchase counts as one full month, regardless of the day of purchase.
14.2.5 Example: an item purchased 20 June for £75.00 inc VAT is reported faulty on 29 November (month 6). The refund would be reduced by 30% (6 months × 5%), giving a refund of £52.50.
14.2.6 No postage costs — either your return postage or your original delivery charge — are refundable where you choose a refund under this section.
14.3 Items reported as faulty but returned outside our standard return policy, which we test and confirm are not faulty, are subject to a £4.95 return and administration charge.
15.1 Product warranties may be provided by us or directly by the manufacturer, at our discretion.
15.2 If a product develops a fault outside our returns policy, we will:
15.2.1 offer an exchange for the same product, if available; or
15.2.2 if unavailable, exchange for a product of equal or higher specification.
15.3 If you decline an exchange, Section 14 applies.
15.4 We may seek advice from the manufacturer regarding your warranty claim and will pass on relevant information to you.
15.5 We may, at our discretion, direct you to the manufacturer for warranty support, and will provide the relevant contact details.
16.1 We are not liable for the following, including but not limited to:
16.1.1 loss of earnings or income;
16.1.2 loss of data;
16.1.3 loss of profits;
16.1.4 loss of work;
16.1.5 loss of any contracts;
16.1.6 death or personal injury, except where caused by our negligence; and
16.1.7 errors arising from incorrect information you provided during the order process (e.g. incorrect delivery, email, or invoice address).
16.2 Warranty cover applies only to faults arising from fair wear and tear. We may consult the manufacturer on what constitutes fair wear and tear and will share their guidance with you.
16.3 Product warranty details can be found in the item listing or on our warranty page.
17.1 International orders may be subject to local import duties, taxes, or VAT, which are your responsibility.
17.2 We recommend contacting your local customs office before ordering to establish likely charges.
18.1 All website prices include UK VAT at the applicable rate, currently 20%.
18.2 All orders, domestic and international, are shipped with a VAT invoice.
18.3 Non-EU residents ordering to a non-EU destination will have VAT deducted on items (and delivery, where applicable) at checkout.
18.4 We are not obliged to deduct VAT for EU customers without a valid VAT number.
18.5 EU customers with a valid VAT number may have VAT deducted prior to payment via BACS, on provision of valid VAT documentation.
18.5.1 EU customers paying by Stripe or PayPal will be refunded VAT after purchase on provision of valid VAT documentation.
18.5.2 Without a valid VAT number, the full listed price applies; you may reclaim VAT via your local customs office using our UK VAT invoice.
19.1 We are not responsible for delays or failures caused by events outside our reasonable control, including but not limited to:
19.1.1 adverse weather conditions;
19.1.2 strikes; and
19.1.3 other external or internal factors beyond our control.
20.1 We reserve the right to cancel orders affected by:
20.1.1 pricing errors, including human error;
20.1.2 pricing errors from supplier feeds;
20.1.3 stock errors where we hold no physical stock;
20.1.4 stock errors from supplier feeds;
20.1.5 internal system or technical errors; and
20.1.6 incorrect product descriptions.
21.1 We may send seller review invitations via a third party approximately 10 days after purchase.
21.1.1 To edit a submitted review, contact the review provider directly.
21.1.2 By submitting a review via a third party, you agree that it may be published on their website.
21.2 We may send product review invitations via our own system approximately 10 days after purchase.
21.2.1 We regularly review submitted content and reserve the right to edit or remove it where necessary.
21.3 By submitting a review via our email invite, you agree it may be published on our website.
